These General Conditions of Sale (hereafter "GCS") are offered by the website OhMyWatch!, owned by the company Time Rescue, with registered office at Via XX settembre 1870, 132, 47923 Rimini, Italy. In accordance with Article 27 of Italian Legislative Decree 114/98, the company is registered with the VAT number: 04647900408. Time Rescue is VAT exempt, in accordance with Article 10 of the Italian President's Decree 633/1972. Article 2: Products and services
OhMyWatch! offers the sale of customizable watches. Customers have the option of using an online customization tool to design their watch piece by piece, or choose from a selection of pre-configured watches. The prices of the products vary according to the chosen customization options and are clearly indicated on our website.
Article 3: Payment terms
On OhMyWatch!, it is possible to make your purchases via PayPal or credit card through Stripe. These two payment service providers are globally recognized for their security and reliability. No payment information is stored on our servers. All transactions are secure and encrypted by the HTTPS protocol, thereby ensuring the confidentiality of personal and banking information during the transaction.
Article 4: Delivery
The cost and time of delivery depend on the destination country and the delivery method chosen by the customer. This information is provided to the customer before the completion of the order. The transportation is ensured by reliable public postal services.
Article 5 : Right of withdrawal
In accordance with Article 59 of Italian Legislative Decree 21/2014, the right of withdrawal cannot be exercised for custom-made or clearly personalized products. Therefore, no return or exchange will be possible for these items.
Article 6 : Warranty
All watches sold on OhMyWatch! are covered by a one-year warranty from the date of order. To exercise the warranty, you simply need to communicate your order number and describe the issue encountered. Please note that the warranty does not cover damage caused by improper use of the watch, such as not respecting the indicated water-resistance level, or the use of unsuitable batteries.
Article 7 : Liability
OhMyWatch! cannot be held liable for any delay or failure to comply with these GCS due to events beyond its reasonable control, including but not limited to, natural disasters, governmental actions, wars, fires, floods, explosions, riots, civil disturbances, acts of terrorism, strikes or other labor problems, or network restrictions or blackouts.
Article 8 : Personal data protection
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, OhMyWatch! respects the privacy of its users. A user can modify their personal information directly in their customer area. They can also request the deletion of their account by simply sending an email, specifying their customer number. This will be done within 7 days. A cookie acceptance banner is present on the site.
Article 9 : Dispute resolution
In case of dispute, OhMyWatch! commits to seeking an amicable solution before any legal action. If an amicable solution cannot be found, the dispute will be submitted to the exclusive jurisdiction of the Italian courts.
Article 10 : Changes to the GCS
OhMyWatch! reserves the right to modify these GCS at any time. Changes will come into effect as soon as they are posted on the site. The date of the last modification will always be visible at the end of this document.
